By purchasing, installing, or using MuDefender GameGuard (the "Software"), you (the "Customer" / "Server Owner") agree to these Terms of Service (the "Terms"). If you do not agree, do not purchase or use the Software.
2.1 We grant the Customer a non-exclusive, non-transferable, revocable, subscription-based license to install and use the Software to protect the game server(s) covered by the Customer's active subscription. 2.2 The Software is licensed, not sold. All intellectual property rights in the Software remain with the Developer. 2.3 The License is issued per the Customer's subscription plan and is bound to the Customer's server identity/license key. The Customer may not share, sublicense, resell, rent, or redistribute the Software or License keys without our prior written consent.
3.1 The Software is provided as a paid digital subscription license. Fees are charged via PayPal (additional payment methods may be added over time). 3.2 The License activates upon payment and remains valid for the subscription period purchased. 3.3 The Software is a digital product. All sales are final and the license fee is non-refundable. Because the product is delivered digitally and grants immediate access, statutory withdrawal/refund rights for digital goods are waived to the extent permitted by law. Any goodwill refund is granted solely at the Developer's discretion and does not create an obligation or precedent. 3.4 Chargebacks or payment reversals filed in breach of this Section may result in immediate suspension or termination of the License.
The Customer shall not, and shall not permit others to: (a) reverse engineer, decompile, disassemble, unpack, or attempt to derive the source code of the Software (except where such restriction is prohibited by law); (b) circumvent, disable, or tamper with the License, integrity, or protection mechanisms; (c) resell, redistribute, or sublicense the Software; (d) use the Software to process data unlawfully or to harm, surveil, or profile End Users beyond what is necessary for cheat detection; or (e) use the Software on infrastructure the Customer does not control or is not authorized to protect.
5.1 The Customer is the sole data controller for all personal data of End Users that is processed by the Software on the Customer's own servers and infrastructure, including but not limited to IP addresses, MAC addresses, hardware identifiers (HWID), in-game identifiers, process/driver lists, screenshots, and session logs ("Player Data"). 5.2 The Developer has no access to the Customer's servers, databases, or Player Data. All Player Data is captured and stored exclusively on the Customer's own servers (VPS) under the Customer's control, and is automatically deleted on a rolling basis (default: 30 days) unless the Customer chooses to retain or back it up. 5.3 The Customer is solely responsible for complying with all applicable data-protection and privacy laws (including the EU/UK GDPR and any local equivalents) with respect to Player Data, including: providing lawful basis, maintaining the Customer's own privacy policy, informing its Players, honoring data-subject requests, configuring the Software's collection settings (e.g., screenshots on/off, consent prompt), and securing the Player Data on its servers. The Developer is not liable for any data breach, misconfiguration, unlawful processing, or privacy violation occurring on the Customer's servers. 5.4 Cross-server cheater network (HWID sharing). To prevent detected cheaters from moving between participating servers, the Software transmits to the Developer's central systems only a pseudonymous, salted Hardware Identifier (HWID) of a detected offender, together with the detection category/reason, a timestamp, and the Customer's own server IP address. No Player IP address, MAC address, screenshot, in-game name, account, or other Player content is ever transmitted to or stored by the Developer. By using the Software, the Customer consents to participating in this shared cheat-prevention network. The Customer shall disclose this HWID sharing to its Players (the in-game notice and the Developer's Privacy Policy assist with this). 5.5 Developer-side processing. The Developer processes centrally only: (a) Customer account, billing, license, and server-operational data (a business-to-business relationship); and (b) the pseudonymous HWID + detection metadata described in 5.4, for the purpose of cross-server cheat prevention and product improvement. This is further described in the Developer's Privacy Policy.
6.1 The Software is security software that includes a kernel-mode driver and performs memory inspection, process/driver scanning, and code-integrity enforcement, in a manner similar to other industry anti-cheat solutions. 6.2 The Customer acknowledges that, because of this behavior and because the Software is packed/obfuscated to resist reverse engineering, some antivirus or security products may flag the Software as suspicious (false positive). This does not indicate malware. The Customer is responsible for testing the Software in its own environment before deployment. 6.3 False positives. No anti-cheat is perfect; legitimate users may occasionally be flagged. Final ban/kick decisions rest with the Customer. The Developer is not liable for actions taken by the Customer against its Players.
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, UNINTERRUPTED OPERATION, OR THAT THE SOFTWARE WILL DETECT OR PREVENT ALL CHEATS.
8.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS, ARISING OUT OF OR RELATED TO THE SOFTWARE. 8.2 THE DEVELOPER'S TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT THE CUSTOMER PAID FOR THE SOFTWARE IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. 8.3 The Developer is not liable for damage, data loss, false positives, system instability, or third-party (including antivirus) actions, where the Customer has not followed the provided installation and operation guidelines.
The Customer agrees to indemnify, defend, and hold harmless the Developer from and against any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from: (a) the Customer's handling of Player Data; (b) the Customer's failure to inform its Players or to comply with applicable law; (c) the Customer's misuse of the Software; or (d) any claim brought by a Player or third party relating to the Customer's servers or services.
10.1 These Terms apply for as long as the Customer holds an active License. 10.2 We may suspend or terminate the License immediately for breach of these Terms (including Sections 3, 4, and 5). 10.3 We may revoke the digital certificate(s) and/or License associated with a build that is found to be cracked, tampered with, or redistributed. 10.4 Upon termination, the Customer must cease all use of the Software and delete all copies.
We may update the Software (including frequent security updates) and these Terms. Material changes to the Terms will be posted at mudefender.com with an updated effective date. Continued use after changes constitutes acceptance.
These Terms are governed by the laws of the State of New York, United States, without regard to conflict-of-laws rules. The parties submit to the exclusive jurisdiction of the state and federal courts located in New York for any dispute, subject to any mandatory consumer-protection rights that cannot be waived in the Customer's place of residence.
